Eyes on Heroes — Contest Rules




Midwest Eye Care Eyes on Heroes Contest will begin accepting Contest applications on September 1, 2021 and close the application period on September 30, 2021. All applications must be complete and received by 11:59:00 P.M. CST on September 30, 2021 to be eligible.


The object of the Contest is to recognize community Heroes, including emergency responders, community volunteers, teachers and health care workers (Hero), and reward the winner(s) with free LASIK or PRK surgery. Midwest Eye Care (Sponsor) will create a contest page on the website with a form requiring the nominator to complete the following form fields: Hero’s Name, Hero’s Phone Number, Hero’s Email Address, Hero’s City of Residence, Name of Nominator, Email Address of Nominator, Phone Number of Nominator, Hero Category (first responder, community volunteer, teacher, or healthcare worker), Hero’s place of employment, and up to 500 words explaining why the Hero is being nominated (Narrative). The Narrative should highlight the applicant’s background and why the applicant is uniquely qualified to win. Contest applications are limited to one (1) per Nominator. Completed nominations will be vetted and judged on quality of essay, the proximity of Hero’s City of Residence to the Omaha metropolitan area, the ability to contact the Nominator and/or Hero for additional information, consent by the Hero to participate in the contest process, Hero’s contributions to the community, and whether the nominee meets the clinical indications for surgery. All judging will be completed by Midwest Eye Care representatives. Representatives will narrow down the nominations to 15 or fewer finalists, who will be featured on the Midwest Eye Care website. Website visitors will use a poll feature within the site to vote. Voting will be limited to one per day, per IP address. Midwest Eye Care also reserves the right to feature finalists and their stories on its social media channels, including but not limited to Facebook. The Contest Grand Prize Winners will be awarded with free bilateral LASIK or PRK surgery, if they meet the clinical indications for surgery based on a medical exam performed by a Midwest Eye Care doctor. Once voting is completed and the winners have been determined by Midwest Eye Care, an announcement of the winners will be shared on the Midwest Eye Care website and social media channels. The winners’ surgery dates will be scheduled on a case-by-case basis but in all cases must be completed no later than March 31, 2022. Contest Grand Prize Winners will forfeit their claim to free surgery if surgery is not performed by that date.



The Contest is open only to adults, age 18 or older, who are legal residents of Nebraska or the Iowa counties of Pottawattamie, Page, Mills, Fremont, Montgomery, Cass, Taylor, Adams, Shelby, Harrison, or Audubon whose work or contributions fall into one of the following categories: emergency responders, community volunteers, teachers, or health care workers. Individuals who receive federal healthcare coverage including Medicare, Medicaid, or Tricare are not eligible. Midwest Eye Care employees, directors, officers, agents, and any of their immediate family members, including spouses, parents, children, and anyone living in the same household of the immediate foregoing are not eligible. Applicants for the Contest must be able to:

(1) Read and understand the Contest Rules;

(2) Provide proof of the Contest Rules eligibility requirements;

(3) Unconditionally accept and agree to comply with and abide by the Contest Rules and decisions of Sponsor, whose decisions shall be final and binding in all respects;

(4) Be available as the Contest Grand Prize Winner for post award follow-up including, but not limited to interviews, videos, blogs and statements, and photographs.



Sponsor reserves the right to request additional documents as Sponsor may reasonably require in order to effectuate the purposes and intent of the Contest Rules.




To enter the Contest, applicants should visit the Midwest Eye Care Contest Application at and follow the onscreen directions to enter. Incomplete entries or entries that do not fully comply with the Contest Rules and the Submission Guidelines, in the sole discretion of Sponsor, will not be eligible.


Each Nominator must submit a Narrative not exceeding 500 (five hundred) words that describes the Hero’s unique qualifications and why they should be awarded the surgery.



Each applicant must complete and submit the Application Affidavit and Release.

Upon selection of up to 15 finalists, representatives from Midwest Eye Care will contact each finalist for additional information, including written confirmation that they agree to advance to the next round. In order to be eligible for the Contest Grand Prize, finalists must agree to (a) provide written authorization of their agreement which allows Sponsor to include their nomination information on the publicly-available voting website, (b) agree to participate in promotional materials related to the voting process and, if applicable, the awarding of the Contest Grand Prize and the surgical experience thereafter, (c) provide medically relevant medical information to Sponsor for the purpose of determining the finalist’s clinical eligibility for the Contest Grand Prize, and (d) affirm in writing that they meet the eligibility requirements of the Contest. Online voting will be conducted at and will be open for a period of two weeks following the announcement of the 15 finalists. Each finalist is eligible to receive one vote per day per IP address.


If a Hero Category has at least three finalists, then the finalist receiving the most votes among the participants in that Hero Category will be examined by a Midwest Eye Care doctor to determine if the finalist meets the clinical indications for surgery. If they meet the clinical indications for surgery, they will be selected as a Contest Grand Prize Winner. If they do not meet the clinical indications for surgery, then the other finalists in that Hero Category will be evaluated for clinical indications for surgery, starting with the finalist with the highest vote totals and ending with the finalist with the lowest vote totals, until a Contest Grand Prize Winner is determined for that Hero Category. After the Contest Grand Prize Winner is selected from each Hero Category that included at least three finalists, vote totals will be used for the remaining finalists from any Hero Category to determine additional Contest Grand Prize Winners until a total of five Contest Grand Prize Winners have been selected. For example, if three Contest Grand Prize Winners were selected from three Hero Categories which included at least three finalists, two more Contest Grand Prize Winners would be selected based on which of the remaining finalists (a) received the most votes AND (b) subsequently meets the clinical indications for surgery. The final five Contest Grand Prize Winners will not be announced as winners until each has met Midwest Eye Care’s standard for clinical indications for LASIK or PRK surgery.


Grand Prize Winners:

The Contest Grand Prize Winners will be awarded either bilateral LASIK or PRK surgery, with an approximate value of $5,000 per Winner, if they meet the clinical indications for surgery based on a medical exam performed by a Midwest Eye Care doctor. If a Contest Grand Prize Winner does not meet medical qualifications for surgery or forfeits his or her prize, Sponsor will select an alternate winner. There will be a total of five Grand Prizes awarded but there is no guarantee that a Grand Prize will be awarded to an applicant in each Hero Category.


No substitution of any prize shall be offered and no transfer of any prize to a third party is permitted. All federal, state, and any other tax liabilities arising from this Contest are the sole responsibility of the Contest Grand Prize Winners.



Applicants and potential Contest Grand Prize Winners are not Official Contest Grand Prize Winners until confirmed by Sponsor. Potential winners will be notified via telephone or e-mail. Sponsor will make 4 (four) attempts on 2 (two) days to contact potential winners via telephone. Sponsor will make 3 (three) separate attempts 2 (two) days apart to contact the potential Contest Grand Prize Winners via e-mail. Sponsor may make the telephone and initial e-mail attempts the same day. Potential Contest Grand Prize Winners will have 5 (five) calendar days from the time of the first notification attempt to respond to Sponsor. It is the sole responsibility of the Applicant to notify the Sponsor in writing if the Applicant’s e-mail, phone number, or postal address changes during or shortly after the Contest timeframe. If any notification attempt fails or is returned for any reason, Sponsor reserves the right to determine that the potential winner has forfeited the prize. Sponsor then has the right to select an alternate potential winner.



Except as otherwise stated in the Contest Rules, including the required Applicant Affidavit and Release, any personal information collected in connection with this Contest will be used in accordance with the Sponsor’s Notice of Privacy Practices and with any other consent given by an applicant. Participation in this Contest constitutes consent to Sponsor’s Notice of Privacy Practices. Any communication or information transmitted to Sponsor in any form will be treated as protected health information, and consent to share limited protected health information will be required from the applicant in order to participate in this Contest.


Collection of Information:

The information which Sponsor collects for the Contest may include personally identifiable information (Personal Information) which refers to information that helps it identify users or viewers of the Website (collectively, “Users” and each a “User”). The Personal Information includes data such as a User’s name, street address, phone number, and e-mail address. The Website allows Users to submit Personal Information in order to contact or communicate with Sponsor. If User contacts Midwest Eye Care through its website (, please note that Personal Information may be maintained by the Website. Users are responsible for keeping all Personal Information current and may change any previously entered information through the Website.

Use of Information:

Sponsor may use the information that is collected about applicants for a variety of purposes. Information may be used to confirm and fulfill prizes. The information Sponsor collects may include:



Complete mailing address;

Phone number;

E-mail address;

Demographic information such as zip code, preferences, and interests;

Information to periodically send promotional correspondence about new products, special offers, or other information which Sponsor thinks you may find interesting or that might improve your experience with Midwest Eye Care services.


Sponsor will not sell, distribute, or lease your Personal Information to third parties without your permission or unless required by law to do so. Sponsor may also collect non-personally identifiable information from you when you visit the Website, such as your IP address, browser type, or domain name. This information is collected and analyzed in the aggregate in order to improve the function and content of the Website.

Security of Collected Information:

Once collected, Sponsor maintains physical, electronic, and administrative steps to ensure that the Personal Information they have about you remains accurate, timely, and secure from unauthorized or inappropriate access. No data transmission is guaranteed to be completely secure, although Sponsor does strive to protect Personal Information. Sponsor is not responsible for harm that may result as a result of a breach of confidentiality in respect to your use of the Website or any information you transmit to the Website.


Collection of Non-Personal Information:

Sponsor may collect certain aggregate and non-personal information when you visit the Website. Aggregate and non-personal information does not relate to a single identifiable visitor. It identifies things such as how many users have visited the Website and the pages accessed. By collecting this information, Sponsor learns how to best tailor the Website to visitors. This information may be collected through “cookie” technology.


Cookies are small pieces of information that are stored on computer hard drives when you visit a website. Cookies are common to most websites. Sponsor may use browser cookies to identify if you have previously been to the Website or if you are new to the Website. Sponsor may use this information to provide visitors with a better user experience. Sponsor Website cookies do not intentionally contain any Personal Information. Sponsor may allow third parties to use cookies on the Website. Sponsor does not control the use or contents of third-party cookies. Web browsers often allow you to erase existing cookies from your hard drive, block the use of cookies, or be notified when cookies are encountered. If you elect to block cookies, you may not be able to take full advantage of the features and functions of the Website.

Policy Modifications:

Sponsor reserves the right to revise, change, amend, alter, or modify (“Update”) their Notice of Privacy Practices and its other policies and agreements at any time and in any manner, including through the required Contest Applicant Affidavit and Release. Applicants are responsible for periodically checking for any updates of this Notice of Privacy Practices by re-visiting the Website and using the browser refresh button. Any updates supersede any prior versions immediately upon posting on the Website. If you do not agree with the terms of Sponsor’s Notice of Privacy Practices or any updated terms, your sole remedy is to refrain from using the Website and entering the Contest.

Protection of Minors:

Sponsor does not knowingly collect or use any Personal Information from minors (younger than 18) through the Website. If you are a parent and believe Sponsor may have inadvertently collected such information from your minor, please notify Sponsor by calling: 402-552-2020.

The Contest restrictions and conditions stated herein are not all-inclusive and may be subject to additional restrictions and conditions. Sponsor specifically reserves the right to modify the Contest Rules for clarification purposes without materially affecting the terms and conditions of the Contest. Applicants agree that Sponsor is not responsible or liable for any losses, damages, or injuries of any kind resulting, in whole or in part, directly or indirectly, from participation in the Contest or any activity related to the Contest. Sponsor reserves the right in its sole discretion to cancel or suspend the Contest, in its entirety or in part, for any reason. Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by internet users, by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human errors which may occur in the processing of the entries in the Contest. Sponsor reserves the right at its sole discretion to disqualify any Applicant. Sponsor is not responsible for entries that are late, forged, incomplete, misdirected, lost, misplaced, stolen, delayed, garbled, damaged, inaccurate, undelivered, destroyed, or in any manner not in compliance with the Contest Rules. All prizes are awarded without warranty of any kind, express or implied. Any attempt by any individual to deliberately damage a Contest application or to undermine the legitimate operation of the Contest is a violation of criminal and civil laws. Sponsor reserves the right to seek damages and costs, including attorney fees, to the full extent permitted by law. The Contest is governed by and will be construed in accordance with the laws of the State of Nebraska. The sole and exclusive forum and venue for any dispute shall be in Omaha, Nebraska. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney fees or any other related costs of bringing a claim, rescinding the agreement, seeking injunctive or any other equitable relief.
